ALL PARTICIPANTS IN ROAD RACES CONDUCTED BY ARTS ON THE HORIZON AND THEIR RELATED EVENTS (“EVENT”) ARE REQUIRED TO, AND HEREBY DO, ASSUME ALL RISK OF PARTICIPATION IN THE EVENT BY SIGNING THIS GENERAL RELEASE AGREEMENT: The undersigned participant (“Participant”) on behalf of himself/herself, any minors participating with Participant in the Event, and on behalf of Participant’s personal representatives, assigns, heirs, executors, and successors hereby fully and forever release, waives, discharges and covenants not to sue Arts on the Horizon and all affiliated persons, including but not limited to its board of directors, staff, volunteers, affiliated corporations and charities, the host city, county and state, any and all municipal agencies whose property and/or personnel are used or in any way assist, all sponsoring or co-sponsoring companies, and all other individuals related to the Event, together with their officers, directors, employees, shareholders, successors and assigns (collectively, “Releasees”) from all liability to the Participant and his/her property or resultant death, in connection with Particpant’s participation and/or attendance related to the Event. Participant is fully aware of the risks and hazards inherent in participating in the Event, acknowledges that there may be additional risks and hazards involved with participating in the Event that Participant is not aware of, and hereby represents and warrants that he/she is able to safely participate in the Event and elects to voluntarily participate in the Event. Participant hereby assumes and accepts full responsibility for himself/herself and all minor children in his/her care, custody, and/or control, for all loss(es), damage(s), injury(ies), death(s) or loss(es) of personal property and expenses that may be sustained by him/her or any minor children in his/her care, custody and/or control while participating in the Event, including any due to his/her own negligence. Participant agrees to the use of his/her name and photograph in broadcasts, newspapers, brochures, and other media without compensation. Participant acknowledges that the entry fee paid is non-refundable and non-transferable. Participant acknowledges and agrees that Arts on the Horizon, in its sole discretion, may delay or cancel Event for any reason. If the Event is delayed or canceled for any reason, including but not limited to: fire, threatened or actual strike, labor difficulty, work stoppage, insurrection, war, public disaster, flood, unavoidable casualty, acts of God or the elements (including without limitation, rain, hail, hurricane, tornado, earthquake), or any other cause beyond the control of Arts on the Horizon, there shall be no refund of the entry fee or any other costs of Participant in connection with the Event. Participant hereby grants medical representatives of the Event to offer medical treatment as needed. Participant understands that he/she has the right to refuse medical care and advice of Event medical representatives; if Participant’s medical condition becomes such that Participant’s mental capacity is questioned, the physician has the right to recommend and initiate treatment of Participant. Participant agrees and understands that Participant hereby assumes liability for any and all medical expenses incurred as a result of training for and/or participation in the Event, including but not limited to ambulance transport, hospital stays, physician and pharmaceutical goods and services. Participant warrants that all statements made herein are true and correct and understands that Releasees have relied on them in allowing Participant to participate in the Event. By signing this Release, Participant agrees that any disputes arising out of or relating to this Release shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules.
